Please read these Terms and Conditions ("Terms") carefully before signing up for a Squarelet Account operated by Squarelet Sdn. Bhd. (“we”, “us” and “Squarelet”).
By signing up for a Squarelet Account or by using any Squarelet Services, you are agreeing to be bound by the following terms and conditions.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
Account Terms
- You must provide your full legal name, current address, phone number, a valid email address, and any other information as required. You agree to provide written notice to Squarelet on any change of the information. Squarelet may reject your application for an Account, or cancel an existing Account, for any reason, in our sole discretion.
- You acknowledge that Squarelet will use the email address provided to updated you from time to time as the primary method for communication.
- You are responsible for all activity and content such as photos, images, videos, graphics, written content, information, or data uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with your Account (“Materials”).
- A breach or violation of any term in the Terms of Service, as determined in the sole discretion of Squarelet may result in an immediate termination of your Services.
- In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm Account ownership. Squarelet retains the right to determine, in our sole judgment, rightful Account ownership and transfer an Account to the rightful Shop. If we are unable to reasonably determine the rightful Shop, without prejudice to our other rights and remedies, Squarelet reserves the right to temporarily disable an Account until resolution has been determined between the disputing parties.
- Squarelet do not claim any intellectual property rights over the Materials you provide to the Squarelet Service. All Materials you upload remains yours. You can remove your Shop at any time by deleting your Account.
General Terms
- Technical support in respect of the Services is only provided to Squarelet Users.
- You acknowledge and agree that Squarelet may amend these Terms of Service at any time by posting the relevant amended Terms of Service on https://Squarelet.com/Terms.aspx and such amendments to the Terms of Service are effective as of the date of posting. Your continued use of the Services after the amended Terms of Service are posted to Squarelet’s website constitutes your agreement to, and acceptance of, the amended Terms of Service. If you do not agree to any changes to the Terms of Service, do not continue to use the Service.
- Any new features or tools which are added to the current Services shall be also subject to the Terms of Service.
- You may not use the Squarelet Services for any illegal or unauthorized purpose nor may you, in the use of the Service, infringe any laws within and without Malaysia and you agree to keep Squarelet in indemnity against all claims, actions, suits, demands, losses, costs and expenses whatsoever.
- You will comply with all applicable laws, rules, and regulations in your use of the Service and your performance of obligations under the Terms of Service.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Services, or access to the Services without the express written permission by Squarelet.
Squarelet Rights
- We reserve the right to modify or terminate the Services for any reason, without notice at any time.
- We reserve the right to refuse service to anyone for any reason at any time.
- Verbal or written abuse of any kind to any Squarelet customer, Squarelet employee, will result in immediate Account termination.
- It is in our sole discretion to refuse or remove any Products from the Service, including your Online Shop.
- We reserve the right to provide our services to your competitors and make no promise of exclusivity.
- By uploading Materials, you agree:
- to allow other internet users to view the Materials you post publicly to your Shop
- to allow Squarelet to store, and in the case of Materials you post publicly, display and use your Materials
- That Squarelet can, at any time, review and delete all the Materials submitted to its Service, although Squarelet is not obligated to do so.
Limitation of Liability
- You expressly understand and agree that, Squarelet shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Service.
- In no event shall Squarelet be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with our site, our Services, or these Terms of Service. You agree to indemnify and hold us and partners, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, or your violation of any law or the rights of a third party.
- Your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis without any warranty or condition, express, implied, or statutory.
- Squarelet does not warrant that the Services will be uninterrupted, timely, secure, or error-free.
- Squarelet does not warrant that the results that may be obtained from the use of the Services will be accurate or reliable.
- Squarelet does not warrant that the quality of any products, services, information, or other materials purchased or obtained by you through the Services will meet your expectations, or that any errors in the Services will be corrected.
- The failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
- You agree that all the products on your online shop are produced, listed, and sold directly by you, Squarelet cannot and does not make any warranties about its quality, safety, or even their legality. Any legal action related to an item you sold cannot be brought against Squarelet.
- There is a Live Chat function to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users.
- You understand that our services may contain links to third-party websites or services that we do not own or control (for example, links to Facebook). It is your own risk, when you access these third-party services, the third parties may require you to accept their own terms of use. These are solely between you and the third party. Squarelet is not a party to those agreements.
Payment of Fees
- You will pay and agree to accept the fees, rates, and service charges applicable based on your subscription that has been offered by Squarelet. Squarelet reserves the rights to change the said fees, rates, and service charges by giving a 30 days’ notice.
- You further understand that Squarelet reserves the rights to terminate your agreement and/or remove your online shop if you do not pay the said fees, rates, and services charges on time.
- You understand that all payments made to Squarelet are non-refundable.
- You (SHOP OWNER) can only change your bank account details once. For your protection, any subsequent changes require a physically signed application form. Please email us with new bank statement information for updates. Email to: BankDetails@Squarelet.com
Termination & Cancellation
- You may cancel your account at any time by contacting Squarelet Live Chat Support.
- Upon termination of your services:
- Squarelet will end providing you with the Services and you will no longer be able to access your Account
- You will not be entitled for any refund
- Your online shop will be taken offline
- Your domain will no longer be renewed if you have purchased a domain with Squarelet. Squarelet will assist to transfer your domain to another provider by providing the EPP/AUTH code, if possible.
Changes to Features, Services and Prices
- Prices for using the Services are subject to change upon 30 days’ notice from Squarelet. Such notice may be provided at any time by posting the changes to the Squarelet website (https://Squarelet.com) or SQNews.
- Squarelet reserves the right at any time to modify or discontinue the Services (or any part thereof) with or without notice.
- Squarelet shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
